What Is An EB-5 Visa?
The EB-5 immigrant investor visa program is a United States initiative designed to stimulate job creation through foreign investment. It presents an opportunity for foreign nationals and their families to secure permanent residence (a green card) in the U.S. by making an investment of at least $800,000 with an approved investment - an exceptional pathway towards citizenship. To qualify for this immigration benefit, EB-5 petitioners must substantiate that their investment has led to the establishment of a minimum of 10 new full-time jobs for American workers, amongst other requirements.
The EB-5 Program
Established in 1990 by the United States Congress, the EB-5 Immigrant Investor Program is designed for eligible foreign nationals aiming to secure lawful permanent residency through investment in the U.S. economy, resulting in the creation of a minimum of 10 full-time U.S. jobs. The program is currently overseen by U.S. Citizenship & Immigration Services (USCIS). While the mandated investment is $1.05 million, it can be lowered to $800,000 if the investment is made in a targeted employment area (TEA), characterized as either a rural or high unemployment area.
The EB-5 immigration process involves several steps for an investor to obtain a green card. After selecting a project, the investor collaborates with their immigration attorney to file the I-526E petition, seeking conditional residency. USCIS reviews this petition to assess the eligibility of the investor and qualifying family members for the conditional EB-5 visa(s). This phase entails a thorough examination of the investor's fund sources, family history, and representations in the petition. The petition, associated with the regional center's I-956F petition, includes a comprehensive description of the EB-5 investment project and any economic models used for job creation assessment. Upon I-526E petition approval, the investor schedules a consular interview to obtain a two-year conditional green card. Subsequently, the investor and family establish residency in the United States.
Approaching the end of the two-year conditional residency period, the investor's immigration attorney files another petition with USCIS (Form I-829) to remove conditions. This petition demonstrates the full and at-risk investment of the EB-5 participant's capital during the two-year period and the creation of the required 10 qualifying jobs. Upon I-829 approval, the investor and family members attain lawful permanent residency, with the option to pursue U.S. citizenship.
The U.S. EB-5 visa is a permanent visa without future re-qualification requirements, offering more advantages and fewer constraints than any other visa program globally. Notably, the EB-5 visa has no stipulations regarding age, business training, management skills, experience, or language proficiency.
